By creating an account, accessing, or using voip.army services ("Services"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Services. If you're agreeing on behalf of a company or other entity, you represent that you have authority to bind that entity.
voip.army provides cloud-based voice over IP (VoIP) telephony services, including but not limited to inbound and outbound calling, text messaging, voicemail, call routing, and related features. The Services are offered subject to availability and may change from time to time.
You must be at least 18 years of age and able to form a binding contract to use the Services. You agree to provide accurate, current, and complete information when registering and to keep that information updated. You are responsible for maintaining the confidentiality of your account credentials.
You agree to pay all fees specified in the pricing plan you select, including applicable taxes and regulatory fees. Fees are billed in advance on a monthly or annual basis depending on your plan. We accept payment by credit card, ACH, or other approved methods.
30-day money-back guarantee. If you cancel within 30 days of initial signup, we'll refund the subscription fees you've paid. Hardware purchases are subject to a separate 30-day return policy.
You will not use the Services to: (a) make calls or send messages that violate applicable law (including the TCPA, telemarketing rules, and CAN-SPAM); (b) make harassing, fraudulent, or abusive communications; (c) bypass our usage limits or attempt to access services you haven't paid for; (d) reverse-engineer or attempt to derive source code from our software; or (e) use the Services to compete with us.
If you port a phone number to voip.army, you represent that you have the legal right to do so. Phone numbers ported to voip.army are assigned to your account and may be ported away at any time, subject to applicable porting procedures. Numbers assigned to you by voip.army (rather than ported) remain our property and may be reclaimed upon account termination.
Important: VoIP services have inherent limitations for emergency calls. Service depends on your internet connection. Emergency responders may not automatically receive your physical location. You agree to: (a) keep your registered service address current; (b) inform all users on your account of these limitations; (c) maintain an alternative means of contacting emergency services. Detailed E911 terms are in your account settings.
We target 99.99% uptime as defined in our SLA, available in your account portal. We are not liable for interruptions caused by: your internet connectivity; third-party telecommunications networks; force majeure events; scheduled maintenance announced in advance.
Our handling of your data is governed by our Privacy Policy, incorporated here by reference. For customers requiring HIPAA compliance, a Business Associate Agreement (BAA) is available on the Pro plan.
The Services, including all software, content, and trademarks, are owned by Beneffy Telecom and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
You may cancel your account at any time from your account portal or by contacting support. We may suspend or terminate your account for material breach of these Terms, non-payment, or as required by law. Upon termination, your access ends and your data may be deleted after 30 days (longer for HIPAA customers per BAA terms).
The Services are provided "as is" without warranties of any kind. To the maximum extent permitted by law, our liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.
These Terms are governed by the laws of the State of Florida, without regard to its conflicts of laws principles. Disputes will be resolved in the state or federal courts located in Brevard County, Florida, except as provided in the arbitration clause below.
Any dispute arising from these Terms or the Services will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except for claims that may be brought in small claims court. You and we waive any right to a jury trial or to participate in a class action.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance.
